"The Fix Tech Repair") (collectively "The Fix," "we," "our," or "us")

1. SCOPE AND ACCEPTANCE

These Terms of Sale and Service ("Terms") govern all:

- Repair services

- Product purchases

- Related transactions

Conducted:

- In person at our retail locations

- Through our Website

- Via telephone or other communication channels

By scheduling a repair, purchasing a product, or paying for any service, you acknowledge that you have read, understood, and agree to be bound by:

- These Terms of Sale and Service

- Our Terms of Use

- Our Privacy Policy

2. ESTIMATES AND AUTHORIZATIONS

2.1 Diagnostic Evaluation

Any diagnostic service or estimate we provide is preliminary and non-binding. Actual repair costs may vary once the device is fully examined and disassembled.

Diagnostic fees are non-refundable once service work has begun.

2.2 Service Authorization

When you authorize a repair (whether electronically, verbally, or in writing), you:

- Permit our technicians to handle, test, or disassemble your device as necessary

- Authorize the installation of replacement parts

- Accept the estimated cost of service

2.3 Additional Work

If additional repairs are discovered during service:

- We will contact you for approval before proceeding

- You may approve or decline additional work

- Original diagnostic fee still applies

2.4 Right to Refuse Service

We reserve the right to decline or discontinue service if:

- Repair is deemed unsafe or beyond reasonable recovery

- Device shows signs of modification that voids warranty

- Repair is uneconomical

- Customer cannot be reached for authorization

- Payment is not provided

3. PRICING AND PAYMENT

3.1 Pricing

Prices displayed online or in-store are estimates and may vary based on:

- Device model and condition

- Parts availability

- Geographic location

- Complexity of repair

Final price will be confirmed before service is completed.

3.2 Payment Terms

Payment is due at the time of service completion unless otherwise agreed in writing.

We accept:

-    Major credit and debit cards (Visa, Mastercard, American Express, Discover)

If using a third-party payment processor, your payment information will be subject to that processor’s privacy and terms.

 

- Cash (at retail locations)- Other payment methods as displayed on our Website

 

3.3 Currency and Taxes

All amounts are quoted and payable in U.S. Dollars (USD). Sales tax and other applicable taxes will be added in accordance with state and local law.

3.4 Deposits

For certain services, we may require a deposit:

- Deposit amount will be specified at time of booking

- Deposits are applied toward final service cost

- Deposits are non-refundable once service work has begun

4. CUSTOMER RESPONSIBILITIES

4.1 Data Backup

YOU ARE SOLELY RESPONSIBLE FOR BACKING UP ALL PERSONAL DATA, CONTACTS, PHOTOS, APPLICATIONS, OR SOFTWARE BEFORE SUBMITTING YOUR DEVICE FOR SERVICE.

The Fix is not liable for:

- Data loss or corruption

- Inability to retrieve information

- Software malfunctions

- Password or account access issues

We strongly recommend:

- Creating a complete backup before service

- Removing SIM cards and memory cards

- Disabling security features (Find My iPhone, etc.) where possible

4.2 Device Ownership

You represent and warrant that you are:

- The lawful owner of the device, OR

- An authorized agent with permission to seek repair

You are responsible for any content stored on the device.

4.3 Password and Account Access

If password or account access is required for diagnostic or repair:

- You agree to provide necessary credentials

- You are responsible for re-securing your device after service

- We will not access your personal data except as necessary for service

4.4 Abandoned Devices

Devices left uncollected for 60 days after notification of service

completion will be considered abandoned.

Abandoned devices may be:

- Disposed of in accordance with applicable law

- Recycled or destroyed

- Sold to recover storage costs

We are not responsible for abandoned devices beyond the 60-day period.

We will make reasonable attempts to contact you before disposal.

 

5. REPAIR PARTS AND QUALITY

5.1 Replacement Parts

Replacement parts used in repairs may be:

- New original manufacturer parts

- New aftermarket parts

- Refurbished or equivalent parts

- Compatible parts that meet or exceed original specifications

All parts are selected for quality, performance, and reliability.

5.2 Part Authorization

By authorizing repair, you authorize the installation of compatible parts

that may not be original manufacturer parts.

5.3 Removed Parts

Unless otherwise agreed in writing:

- Replaced parts become property of The Fix

- Removed parts will be recycled or disposed of properly

- You may request to keep removed parts (additional fee may apply)

5.4 Parts Warranty

Parts are covered under our Limited Warranty (see Section 6).

 

6. LIMITED WARRANTY ON REPAIRS

6.1 Warranty Coverage

Repairs performed by The Fix carry a 90-DAY LIMITED WARRANTY on parts

and labor, effective from the date of service completion.

The warranty covers:

- Defects in replacement parts

- Defects in workmanship

- Failure of the specific repair performed

6.2 Warranty Exclusions

The warranty DOES NOT cover:

Physical Damage After Service:

- Drops, impacts, or crushing

- Water or liquid damage

- Exposure to extreme temperatures

Customer Actions:

- Tampering or modification

- Unauthorized repairs by third parties

- Misuse or abuse

- Failure to follow care instructions

Unrelated Issues:

- Pre-existing conditions not repaired

- Software corruption or malware

- Operating system issues

- Data loss

- Battery degradation from normal use

Device Age and Condition:

- Normal wear and tear

- Age-related component failure

- Cosmetic issues not related to repair

 

6.3 Warranty Claims

To make a warranty claim:

- Present proof of service (receipt or work order)

- Bring device to original service location (or nearest location)

- Allow inspection and diagnostic testing

Warranty Remedies (at The Fix's sole discretion):

- Re-repair of the defective work

- Replacement of defective part

- Refund of service cost

6.4 Exclusive Remedy

The remedies in this Section 6 are your EXCLUSIVE remedies for breach of

warranty.

7. MANUFACTURER WARRANTY AND THIRD-PARTY REPAIRS

IMPORTANT NOTICE:

Repairs performed by The Fix or installation of third-party parts MAY

VOID your device's original manufacturer warranty.

By authorizing service, you:

- Acknowledge this risk

- Assume full responsibility

- Release The Fix from liability for any resulting warranty loss or

 manufacturer denial of coverage

We recommend:

- Checking your manufacturer warranty status before repair

- Contacting your manufacturer with questions about warranty impact

- Considering manufacturer repair if still under warranty

We are not affiliated with or authorized by device manufacturers unless

specifically stated.

8. RETURNS AND REFUNDS FOR PRODUCTS

8.1 Return Period

 

Products purchased from The Fix may be returned within 14 DAYS of purchase if:

- Unused and in original condition

- In original packaging with all materials

- Proof of purchase provided (receipt or order confirmation)

- Item is eligible for return (see exclusions below)

8.2 Non-Returnable Items

The following items are NON-RETURNABLE:

Opened Items:

- Screen protectors (once opened)

- Batteries (once packaging is broken)

- Earbuds or headphones (hygiene reasons)

- Software or digital products

Customized Items:

- Personalized or custom-ordered products

- Special orders

Services:

- Diagnostic fees

- Labor charges

- Service fees

Final Sale Items:

- Clearance or closeout items

- Items marked "final sale"

8.3 Return Process

To return a product:

1. Contact us within 14 days: [email protected]

2. Obtain return authorization number (RMA)

3. Ship item with RMA number to address provided

4. Include original receipt and all packaging

Return shipping costs:

- Customer responsible for return shipping unless item is defective

- We recommend insured, trackable shipping

8.4 Refund Process

Once return is received and inspected:

- Refund processed within 10 business days

- Refund issued to original payment method

- Email confirmation sent

Refund amounts:

- Product purchase price refunded

- Original shipping fees are non-refundable (unless item was defective)

- Return shipping costs are non-refundable

8.5 Defective Products

If product arrives damaged or defective:

- Contact us immediately (within 48 hours of delivery)

- We will provide prepaid return shipping

- Full refund including shipping costs

 

9. LIABILITY AND DISCLAIMERS

 9.1 Service Disclaimer SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." THE FIX DOES NOT GUARANTEE THAT ANY REPAIR WILL: - Restore a device to full original functionality - Fix all issues with the device - Prevent future problems - Make the device "like new"

9.2 No Warranties Beyond Limited Warranty EXCEPT FOR THE LIMITED 90-DAY WARRANTY DESCRIBED IN SECTION 6, THE FIX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING: - IMPLIED WARRANTIES OF MERCHANTABILITY - IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE - IMPLIED WARRANTIES OF NON-INFRINGEMENT - WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE

 9.3 Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW: THE FIX AND ITS AFFILIATES, OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, FRANCHISEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY: INDIRECT DAMAGES: - Loss of data or information - Loss of business or revenue - Loss of profits or savings - Loss of use of device - Inconvenience or time spent CONSEQUENTIAL DAMAGES: - Damages that result indirectly from the service - Damages not reasonably foreseeable - Damages to other devices or property PUNITIVE OR EXEMPLARY DAMAGES EVEN IF THE FIX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 9.4 Maximum Liability OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS SHALL NOT EXCEED THE AMOUNT PAID. This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise). 9.5 Essential Basis You acknowledge that this limitation of liability is an essential part of the bargain between you and The Fix, and that we would not provide services at the prices offered without this limitation.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless The Fix, its owners, members, officers, employees, franchisees, and affiliates from any and all claims, demands, damages, losses, liabilities, and expenses (including reasonable attorney fees and costs) arising out of or related to:

- Your device contents, data, or software

- Ownership disputes regarding your device

- Your use of services contrary to these Terms

- Your breach of these Terms

- Your violation of any law or rights of third parties

- Any injury to persons or property caused by your device

 

11. FORCE MAJEURE

The Fix is not liable for failure to perform any obligation due to events

beyond its reasonable control, including but not limited to:

- Acts of God (floods, fires, earthquakes, hurricanes)

- War, terrorism, or civil unrest

- Government actions or regulations

- Labor disputes or strikes

- Internet or telecommunications failures

- Power outages

- Supplier failures or parts shortages

- Pandemics or public health emergencies

During force majeure events:

- Our obligations are suspended for the duration

- We will make reasonable efforts to resume service

- You may cancel orders and receive refunds for unperformed services

12. ARBITRATION AND DISPUTE RESOLUTION

12.1 Informal Resolution

Before filing any legal action, you agree to first attempt to resolve disputes informally by contacting:

- Your name and contact information

- Description of the dispute

- Proposed resolution

We will respond within 30 days and attempt to resolve the dispute in good faith.

12.2 Governing Law

These Terms shall be governed by and construed in accordance with the

laws of the State of New Jersey, without regard to conflict-of-law

principles.

12.3 Jurisdiction and Venue

Any disputes that cannot be resolved informally shall be brought

exclusively in the state or federal courts of Bergen County, New Jersey.

You consent to such jurisdiction and venue.

Exception:

Where a state franchise law mandates another venue for franchise-related

matters, that venue shall apply solely to those matters.

12.4 Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT:

- Disputes will be resolved on an individual basis only

- You waive any right to participate in a class action lawsuit

- You waive any right to participate in a class-wide arbitration

- You may not act as a class representative or member

 

If this waiver is found unenforceable, the arbitration provision is void.

 

13. MISCELLANEOUS PROVISIONS

13.1 Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions remain in full effect. Invalid provisions will be modified to the minimum extent necessary to make them valid and enforceable.

13.2 Entire Agreement

These Terms, together with:

- Our Terms of Use

- Our Privacy Policy

- Any written service order or receipt

Constitute the complete agreement between you and The Fix regarding sales

and services.These Terms supersede all prior agreements, understandings, and

representations.

13.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

13.4 Assignment

You may not assign or transfer these Terms or any rights hereunder without

our written consent.We may assign these Terms to any affiliate or in connection with a merger, acquisition, or sale of assets.

13.5 Notices

Notices to you may be provided:

- By posting on the Website

- By mail to your address on file

CUSTOMER AUTHORIZATION AND ACKNOWLEDGMENTS

 

By submitting a repair request, I acknowledge and agree to the following:

 1. AUTHORIZATION FOR SERVICE

I authorize The Fix Tech Repair / The Fix Solutions ("The Fix") to

perform diagnostic testing, repair, and related services on my device.

I understand that:

- Diagnostic procedures may involve partial or complete disassembly of

 the device

- Repair services may void existing manufacturer or third-party warranties

- The Fix may use compatible new, used, or refurbished parts that meet

 or exceed original performance specifications

- Actual repair costs may differ from the estimate once the device is

 fully examined

 

 2. DATA AND BACKUP RESPONSIBILITY

I acknowledge that I am solely responsible for backing up my data, applications, contacts, photos, and other personal information prior to

service.I release The Fix from any liability for:

- Loss, corruption, or deletion of data

- Disclosure of data that may occur during diagnostic or repair work

- Inability to retrieve information after service

- Software malfunctions or operating system issues

 

I confirm that I have:

 Backed up all important data

 Removed SIM card and memory cards (if applicable)

 Disabled security features (Find My iPhone, etc.)

 Provided any necessary passwords or account access

 3. DEVICE OWNERSHIP

I represent and warrant that I am the lawful owner of the device or an

authorized agent with permission to seek repair.from any liability related to device contents.

 4. LIMITED WARRANTY ON REPAIR

I understand that all repairs performed by The Fix carry a 90-DAY LIMITED

WARRANTY covering only defects in parts and labor.

The warranty EXCLUDES:

- Accidental or liquid damage after service

- Physical damage (drops, impacts)

- Software or data issues

- Tampering or unauthorized repairs by third parties

- Normal wear and tear

- Any further damage unrelated to the original repair

Warranty claims require:

- Presentation of this signed form

- Proof of service

- Inspection of device

Warranty remedies (at The Fix's discretion):

- Re-repair of defective work

- Replacement of defective part

- Refund of service cost

 5. LIABILITY RELEASE

I agree that The Fix, its affiliates, franchisees, and technicians shall not be liable for any indirect, incidental, or consequential damages, including:

- Data loss

- Loss of revenue or business

- Loss of use of device

- Inconvenience or time spent

The Fix's maximum liability shall not exceed the amount paid for the

service or $100, whichever is greater.

 6. MANUFACTURER WARRANTY IMPACT

I understand and acknowledge that repair services performed by The Fix or installation of third-party parts MAY VOID my device's original manufacturer warranty .I accept this risk and release The Fix from any liability for warranty loss or manufacturer denial of coverage.

 7. PAYMENT TERMS

I understand that:

- Payment for services is due at completion unless otherwise agreed in

 writing

- Any deposits or diagnostic fees are non-refundable once service work

 has begun

- I am responsible for the full cost of authorized repairs

 

 8. UNCLAIMED DEVICES

I understand that devices left uncollected for 60 DAYS after notification

of completion will be deemed ABANDONED.Abandoned devices may be disposed of in accordance with applicable law.

The Fix is not responsible for devices left beyond the 60-day period.

 9. TERMS AND CONDITIONS

I confirm that I have:

- Read and understood this Repair Authorization & Acknowledgment Form

- Had the opportunity to ask questions about the repair and terms

- Been provided access to The Fix's Terms of Sale and Service Agreement

 and Privacy Policy

- Agree to all terms and conditions

 10. CONSENT TO PROCEED

I authorize The Fix to proceed with diagnostic and repair services on my

device according to the terms outlined above.
